Behavioural Standards for Council Members

The Behavioural Standards for Elected Members commenced on 17 November 2022.

Pursuant to Section 75E of the Local Government Act 1999, the Code of Conduct for Council Members as gazetted by the Minister for Local Government on 3 November 2022 automatically applies to Council Members effective 17 November 2022.

Council Members must comply with the provisions of this code in carrying out their functions as public officials.

Gifts, Benefits & Allowances

For the purposes of Regulation 35(2)(d) of the Local Government (General) Regulations 2013, the threshold amount governing when a gift or benefit must be registered has been gazetted at $50.

The Elected Members Gifts and Benefits Register is available on Council’s Website and updated on a monthly basis.

Elected Members Allowances and Benefits Register (Section 79)

Pursuant to Section 79 of the Local Government Act 1999, the Council must keep a Register of Allowances and Benefits, in accordance with principles (if any) prescribed by the regulations, in respect of each member of the Council:

  1. the annual allowance payable to the member; and
  2. details of any expenses reimbursed by the Council under Section 77(1)(b); and
  3. details of other benefits paid or payable to, or provided for the benefit of, the member of the Council.

The Register of Members Allowances and Benefits can be inspected (without charge) at the Council Office and a copy obtained on payment of a fee fixed by Council. A copy of each monthly Register is available below.

Register of Interests

Pursuant to Section 79 of the Local Government Act 1999, the Council must keep a Register of Allowances and Benefits, in accordance with principles (if any) prescribed by the regulations, in respect of each member of the Council:

  1. the annual allowance payable to the member; and
  2. details of any expenses reimbursed by the Council under Section 77(1)(b); and
  3. details of other benefits paid or payable to, or provided for the benefit of, the member of the Council.

The Register of Members Allowances and Benefits is available on Council’s Website and updated on a monthly basis. A copy of each monthly Register is available below.

Elected Members Mandatory Training Register 2022-2026

The Elected Members’ Training and Development Policy and Training Program allows members to maintain and improve their knowledge base to assist them in carrying out their official functions and duties. Pursuant to Regulation 8AA of the Local Government (General) Regulations 2013, the Elected Members completed the 4 mandatory Training Modules within the first 12 months of their term of office.

Elected Members Register of Conflict of Interest (Section 74 and 75)

Section 74 – If a member of a Council discloses a general conflict of interest in a matter to be discussed at a meeting of the Council, the following details must be recorded in the minutes of the meeting:

  1. the Member’s name;
  2. the nature of the interest, as described by the member;
  3. the manner in which the member dealt with the general conflict of interest;
  4. if the member voted on the matter, the manner in which the member voted;
  5. the manner in which the majority of persons who were entitled to vote at the meeting voted on the matter.

Section 75 – If a member of a Council discloses a material conflict of interest in a matter to be discussed at a meeting of the Council, the following details must be records in the minutes of the meeting:

  1. the member’s name;
  2. the nature of the interest, as described by the member;
  3. if the member took part in the meeting, under an approval under subsection (3), the fact that the member took part in the meeting.
