Ancillary Accommodation and Student Accommodation Definitions Review Code Amendment

Notice of consultation by the Chief Executive of the Department for Trade and Investment on the Ancillary Accommodation and Student Accommodation Definitions Review Code Amendment.

The Chief Executive of the Department for Trade and Investment has now released the Ancillary Accommodation and Student Accommodation Definitions Review Code Amendment (the Code Amendment) for consultation as required under the Planning, Development and Infrastructure Act 2016 (the Act).

In February 2024, the Minister for Planning agreed to a Proposal to Initiate the Code Amendment under section 73(2)(b) of the Act, which enables the Chief Executive to propose an amendment to the Planning and Design Code (the Code).

The Code Amendment proposes to review the definitions for ‘ancillary accommodation’ and ‘student accommodation’ to allow these forms of accommodation to be self-contained.

Due to the urgency of supporting self-contained ancillary accommodation in response to the housing crisis, the Code Amendment has come into effect on an interim basis at the same time as being released for consultation.

We are now seeking your feedback, with public consultation being undertaken from 29 February 2024 until 11 April 2024.

Consultation is taking place in accordance with the engagement plan prepared by the Chief Executive and as required by the Community Engagement Charter under the Act.

We anticipate the final engagement report and Code Amendment will be provided to the Minister for Planning for determination in mid-2024. These documents will be published on the PlanSA portal within five (5) business days of the Minister’s decision.
